Terms of service

Effective April 1, 2026

These terms govern your use of Tapemetric Analytics. By creating an account, embedding our SDK, or calling our API, you agree to them on behalf of yourself and your organization.

1. The service

Tapemetric provides a video analytics platform — an SDK, an HTTP ingest API, an analytics query API, and a web admin console. Service availability targets and feature inclusion are described on the Pricing page and in your order form.

2. Account responsibilities

You are responsible for:

  • Maintaining the confidentiality of your API keys and account passwords.
  • The activity of users you grant access to your workspace.
  • Ensuring you have legal basis to send us the end-viewer event data you send.
  • Notifying your end-viewers, where required, that analytics data is being collected.

3. Acceptable use

You may not:

  • Send us data that you don’t have the right to process.
  • Use the service to track individuals without their knowledge or a lawful basis.
  • Reverse-engineer, scrape, or mass-export the admin panel UI to circumvent API quotas.
  • Use the service to develop a competing analytics product.
  • Send data through the SDK or API for any purpose other than analytics on your platform.

4. Quotas and overage

Each plan includes a monthly event quota. Beyond the quota, Pro and Enterprise plans incur overage at the rates shown in your billing settings. We send a warning at 80% utilization and a final warning at 100%. We do not silently exceed the quota — you must explicitly opt into overage.

5. Fees and payment

  • Plans bill monthly in advance unless you sign an annual contract.
  • Payment is due on the invoice date; late invoices accrue 1.5% interest per month.
  • All fees are exclusive of GST, which is added at the prevailing rate.
  • Refunds: pro-rated on cancellation for annual plans; not available for monthly plans.

6. Service levels

We target 99.99% ingest uptime and 99.9% admin panel uptime. Enterprise customers get a formal SLA with credits; Pro customers get the targets as a best-effort commitment. Status is published at status.tapemetric.com.

7. Data ownership

You own all event data you send us. We process it on your behalf to provide the service. We do not use your data to train AI models, build aggregate products, or share with third parties. Full details are in the Privacy policy and the Data Processing Agreement.

8. Confidentiality

Each side will protect the other’s confidential information with the same care it applies to its own — at minimum, a reasonable standard of care. Confidential information does not include anything that’s independently developed, lawfully received from a third party, or already public.

9. Termination

Either side can terminate the agreement on 30 days’ notice. We may suspend access immediately for non-payment beyond 30 days, breach of the acceptable use rules, or activity that risks the security of other customers. On termination, you have 30 days to export your data; after that, we delete it within 30 more days.

10. Liability

To the maximum extent allowed by law, our total liability under this agreement is capped at the fees you paid us in the 12 months preceding the claim. Neither party is liable for indirect, consequential, or lost-profits damages.

11. Governing law

This agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

12. Changes

We’ll notify you of material changes to these terms at least 30 days in advance, by email and in the admin panel. Continued use after the effective date constitutes acceptance.
